APPLICATION PRIVACY STATEMENT
Blue Mountains City Council (BMCC)
1.1. Blue Mountains City Council (BMCC) respects your right to privacy and is committed to safeguarding the privacy of our customers and software application users. We adhere to the National Privacy Principles established by the Privacy and Personal Information Protection Act 1998 (NSW). This Statement sets out how we collect and treat your personal information.
1.2. " Personal information” means information or an opinion about an individual whose identity is apparent or can reasonably be ascertained from the information or opinion.
2.1. Blue Mountains City Council (BMCC) will, from time to time, receive and store personal information you enter onto our software application BMCC Staff App, provide to us directly or give to us in other forms.
2.2. Council will only collect personal information for a lawful purpose, and which directly relates to its functions. Council will collect only as much information as is reasonably necessary for that purpose.
2.3. Council will only collect personal information directly from a person. Exceptions to this include:
(a) where an individual has authorised collection from someone else;
(b) where the person is under 16 years of age and information has been collected by a parent or guardian or the person; or
(c) where indirect collection is necessary when an award, prize or benefit is intended to be given to the person
2.4. Council will give certain information to people from whom they collect personal information. Namely:
(a) that information is being collected;
(b) why it is being collected;
(c) to whom the information will be disclosed;
(d) whether the collection of the information is voluntary or required by law and whether there are any consequences for not providing the information; (e) regarding rights to access or amend the information. Council may depart from this principle if the information is being collected for an award, prize or benefit to be given to a person.
2.5. Council will ensure that personal information collected is relevant, accurate, complete and not excessive. Council will ensure that collection of information does not unreasonably intrude into a person’s affairs.
2.6. Contractors acting on Council’s behalf may also collect personal information. Council includes clauses in its contracts that require contractors to comply with relevant privacy obligations.
3.1. BMCC collects personal information from you in a variety of ways, including when you interact with us electronically or in person, when you access our software application and when we provide our services to you. We may receive personal information from third parties. If we do, we will protect it as set out in the BMCC Privacy Management Plan available on our website.
3.2. Council collects personal information to enable it to conduct its functions. Council assesses the level of personal information that is appropriate to be collected on a case-by-case basis. Personal information may be collected electronically, in writing, over the telephone and/or in person.
Personal information may be collected from:
• members of the public;
• NSW public sector agencies;
• businesses; and
• non-government organisations
4.1. BMCC may use personal information collected from you to provide you with information, updates and our services. We may also make you aware of new and additional products, services and opportunities available to you. We may use your personal information to improve our products and services and better understand your needs.
5.1. Council will not disclose a person’s personal information without consent, unless otherwise permitted under the PPIPA or other legislation. Council may disclose information to a public sector agency or public utility if that agency has approached Council in writing and Council is satisfied that the disclosure of the information is reasonably necessary and for the proper or lawful functions of that agency. A further exception applies where the information has been collected with the intention of giving an award, prize or benefit to the person.
5.2. Council will not disclose sensitive personal information. This includes personal information relating to an individual's ethnic or racial origin, political opinions, religious or philosophical beliefs, trade union membership, sexual activities unless the disclosure is necessary to prevent a serious or imminent threat to the life or health of the individual concerned or another person.
6.1. BMCC will keep personal information secure, protect it against loss, unauthorised use or disclosure, and dispose of it securely and in accordance with any requirements for the retention and disposal of personal information when it is no longer necessary”

6.3. Electronic information is stored on secure information systems. Networks will be secure and require individual logins. New systems are assessed for compliance with the Privacy and Personal Information Protection Act 1998 (NSW) and Health Records and Information Privacy Act 2002 (NSW).
6.2. The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Statement.
7.1. You may request details of personal information that we hold about you in accordance with the provisions of the Government Information Public Access Act 2009 (NSW). A small administrative fee may be payable for the provision of information. If you would like a copy of the information which we hold about you or believe that any information we hold on you is inaccurate, out of date, incomplete, irrelevant or misleading, please email us at council@bmcc.nsw.gov.au.
8.1. If you have any complaints about our privacy practices, please feel free to send in details of your complaints to Locked Bag 1005, Katoomba, New South Wales, 2780 or email council@bmcc.nsw.gov.au We take complaints very seriously.
9.1. You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email, at
council@bmcc.nsw.gov.au.
10.1. Please be aware that we may change this Privacy Statement in the future. It is aligned with the Privacy Management Plan on the BMCC website and to all relevant legislation. Changes may be required if the legislation or policy changes.
11.1. When you use our Application
When you come to our application we may collect certain information such as mobile unique device ID, the IP address of your mobile device, mobile operating system, the type of mobile internet browsers you use, and information about the way you use the Application. This information is used in an aggregated manner to analyse how people use our site, such that we can improve our service.
11.2. Cookies
We may from time to time use cookies on our software application. Cookies are very small files which a website uses to identify you when you come back to the application and to store details about your use of the application. Cookies are not malicious programs that access or damage your computer, tablet or smartphone. Most devices automatically accept cookies but you can choose to reject cookies by changing your devise settings. However, this may prevent you from taking full advantage of our application.
11.4. Third parties
Our software application may from time to time have links to other applications or websites not owned or controlled by us. These links are meant for your convenience only. Links to third party applications and websites do not constitute sponsorship or endorsement or approval of these third parties. Please be aware that BMCCis not responsible for the privacy practises of other such applications or websites. We encourage our users to be aware, when
they leave our application or website, to read the privacy statements of each and every application or website that collects personal identifiable information.
11.5. Geo-location
When you visit the mobile application, we may use GPS technology (or other similar technology) to determine your current location in order to determine the city you are located within and display a location map with relevant services. We will not share your current location with other users or partners.
